Negligence: Personal injury settlement recovery on behalf of the widow and children of a gentleman whose wrongful death was caused when he was struck as a pedestrian and killed by a motor vehicle. On July 24, 1997, the Plaintiff, his wife along with three of their eight children were crossing the intersection of State Road 600 and Sun Life Path in Orlando, Florida. Residents of Mexico, the Plaintiff’s family was on a long-awaited vacation to Florida with a tour group. The trip to the United States and visit to Disney World was planned by the Plaintiff and his wife to reward their young children for a successful school year.
On the date of this incident, the Plaintiff’s family — along with the rest of the tour group — was staying at a Hotel located a short distance from the subject intersection. At the time of the incident, the Plaintiff, his wife, and their three minor children were walking back to their hotel room after visiting a nearby store located just across the street. The Plaintiff, his wife and their children had successfully crossed more than two-thirds of the roadway, when the unthinkable occurred. There were no crosswalks in the vicinity of this tragic collision.
