Who May Bring a Florida Wrongful Death Lawsuit
The Florida Wrongful Death Act specifically sets forth who may bring a claim for wrongful death. Section 768.20, Florida Statutes, provides that an action for wrongful death shall be brought by the decedent’s personal representative, who shall recover for the benefit of the decedent’s survivors and estate, all damages specified in the Florida Wrongful Death Act.
Under the Florida Wrongful Death Statute “survivors” are limited to a decedent’s spouse, his or her children, parents and, when partly or wholly dependent on the decedent for support or services, any blood relatives and adoptive brothers and sisters. Survivors also include children born out of wedlock of a mother, but not the children born out of wedlock of a father, unless the father has recognized a responsibility for the child’s support.
The statute specifically prevents parents from recovering for the loss of companionship, instruction, guidance or for mental pain and suffering caused by the wrongful death of an adult child, if the death is due to medical malpractice. This restriction does not apply in non-medical malpractice wrongful death cases.
